By accessing and using this website ("K by Kanika"), you accept and agree to be bound by these Terms and Conditions. Please read them carefully before placing any order.
1. Governing Law and Jurisdiction
1.1. Acceptance of Terms: This agreement is governed by the laws of the Republic of India. You warrant that you are legally capable of entering into binding contracts.
1.2. Jurisdiction: All disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the Courts located in Delhi, India. By placing an order, you irrevocably agree to submit to this exclusive jurisdiction.
2. Products, Orders, and Variation
2.1. Artisan Collection Variation: Items are highly specialised products involving non-standard production processes, such as handloom weaving, manual dyeing, or intricate embroidery. Due to the unique nature of this craftsmanship, slight variations in colour, weave, finish, or measurements may occur when compared to the online image. These minor variations are characteristic of premium, artisan-made products and shall not be considered a defect. Due to lighting conditions, monitor settings and minor discrepancies in colour or texture may still occur.
2.3. Product Accuracy: While we strive for accuracy, we cannot guarantee that your monitor's display of any colour will precisely reflect the actual product colour upon delivery. All orders are subject to product availability.
3. Pricing, Taxes, and Payment
3.1. Pricing and Tax: All prices listed are in Indian Rupees (₹) unless explicitly stated otherwise. Prices are inclusive of Goods and Services Tax (GST) as applicable under Indian laws. Prices are subject to change without prior notice.
3.2. Payment: Your order is considered confirmed only upon receipt of the full payment amount. We reserve the right to cancel an order if payment processing fails or is incomplete.
4. Shipping, Delivery, and Risk
4.1. Shipping Times: Estimated delivery dates are approximations and are not guaranteed. We are not liable for delays caused by third-party courier services or unforeseen circumstances.
4.2. Risk of Loss: The risk of loss or damage to the product passes to you upon delivery, as evidenced by the courier's delivery receipt.
5. Returns, Exchanges, and Cancellations
5.1. Custom/Made-to-Order: Given the personalised design and production of our designer wear, all sales of items are final. These items are not eligible for return or exchange unless a genuine and verifiable manufacturing defect is found upon delivery.
5.2. Notification of Defect: Any request for an exchange due to a genuine defect must be notified to us via email within 24 hours of receiving the product. The item must be returned unused, unworn, unwashed, and with all original tags intact.
5.3. Cancellation Policy: Orders can only be cancelled within 1 hour of placement. After this 1-hour period, the order is moved into production and cannot be cancelled or refunded.
6. Intellectual Property
All content on this website, including designs, text, graphics, and logos, is the exclusive property of K by Kanika and protected by Indian and international copyright laws. You may not use any content without express written permission.
